Consent Agreement

 

1. Request  for Joining the NEC Laboratories Europe GmbH Alumni Network


Background

NEC Laboratories Europe GmbH (in the following “NLE”) invites former employees to join the NEC Laboratories Europe GmbH Alumni Network (hereinafter the “NLE Alumni Network”) and display their professional profile on NLE’s corporate website (https://www.neclab.eu/). NLE alumni will have their professional profiles displayed within the NLE Alumni Network public website area of NLE’s website and, along with current NLE employees, have exclusive or early access to NEC Laboratories content. The alumni can request to opt out of this service at any time.

Alumni professional profiles are displayed in the alumni network section of NLE’s public website and have their own dedicated website page that can be publically shared. Alumni personal profiles have a standard design concept and are displayed in accordance with a template created by NLE. The NLE alumni section of the NLE website follows NLE website design (including text, graphics, links, video material and dynamic content).

Former NLE employees provide their content when they request the service of the NLE Alumni Network and, once accepted as an NLE alumni member, can provide content updates as needed. The NLE alumni section of the NLE website will not be publically available on the NLE website before March 31, 2022. Prior to this time, requests to join the NLE Alumni Network, along with NLE alumni content updates and removal requests, should be sent via email to NLE’s alumni@neclab.eu. After March 31, 2022, the NLE alumni section of the NLE website will be available online and alumni content updates should be requested through the NLE Alumni Network professional profile page.

For questions related to the usage of their data, alumni can email NLE’s webmaster/marketing also at alumni@neclab.eu.  For data protection issues alumni can contact the data protection officer of NLE at dsb@neclab.eu

 

Request for a Professional Profile Page

I would like to have my professional profile published on NEC Laboratories Europe GmbH’s alumni section of the NLE website

In particular, I agree that for this purpose the following data will be processed

  1. My first name and family name (for public display)
  2. A suitable portrait photo, if provided by me (for public display)
  3. My email address for NLE contact (not for public display)
  4. My phone number (not for public display)
  5. Time period worked for NLE (not for public display), only for checking eligibility for the NLE Alumni Network
  6. The name of my current company or organization where I am employed (for public display)
  7. My biography of no more than 150 words (for public display)
  8. My academic title (if you would like this displayed) and my current job title (for public display)
  9. XI. A summary of my research highlights or achievements of no more than 150 words (optional)

As a NLE Alumni member, I acknowledge that the terms and conditions, as attached and signed as Schedule 1 , shall apply to me when registering with the NLE Alumni Network and creating and publishing my NLE Alumni professional profile: At any time, I reserve the right to request that NLE remove or modify my NLE Alumni network professional profile.

  1. The content of points I – IX, described in the section above, will be provided by me and is subject to approval by NLE.
  2. NLE uses as a subcontractor, Mittwald CM Service GmbH & Co. KG, for hosting and maintaining its web services. In addition, NLE uses the subcontractor Sven Schweizer for website development and maintenance. I understand and agree that the content of my profile will be stored at the premises of the third parties contracted by NLE.
  3. NLE will use the information provided by me for the purpose of validating my request to join the NLE Alumni network and publish my NLE Alumni personal profile on the NLE Alumni section of the NLE website.

 

2. Consent in processing the aforementioned data by NEC


Consent

In this declaration, I, hereby voluntarily consent to the processing of my aforementioned personal data by NEC Laboratories Europe GmbH for the purpose of:

  • joining the NEC Laboratories Europe Alumni Network and;
  • publishing and maintaining my NLE alumni professional profile on NEC Laboratories Europe GmbH’s public website that includes the information described in I-IX in the previous section “Request for a Professional Profile Page”.

To the extent that my photo and/or video provides indications to my ethnic origin, religion or health (e.g. skin color, head covering, glasses), my consent also refers to this information.

Information on the Internet

I am aware that information on the Internet is available worldwide, can be found through search engines and therefore can be linked with other information by third parties to potentially create personal profiles about me. Information posted on the Internet, including photos, can easily be copied and distributed. There are specialized archiving services, which aim to permanently document the condition of certain websites on specific dates. This may result in information published on the Internet continuing to be found elsewhere even after it has been deleted on the origin page.

Refusing and/or revoking consent

This consent is voluntary.

I may also revoke this consent at any time to the Managing Director of NLE (e.g., by letter, e-mail). My photo and/or the information on my professional work at NLE will then be  removed without undue delay from NLE’s external and internal websites.

Annex 1: Information pursuant to the EU General Data Protection Regulation (GDPR) for joining the Alumni Network at NEC Laboratories Europe GmbH

This information notice informs you about the processing of your personal data in connection with your activities when joining the NLE Alumni Network and maintain your information as a NLE alumni member. This notice supplements our General Data Protection Policy, which can be found at our website, and possibly other separate information on specific processing activities.

I. Controller and Data Protection Officer

According to Art 4(7) GDPR ”controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. NEC Laboratories Europe GmbH determines the purposes and means of the processing of your personal data, and is therefore the Controller according to and within the meaning of Art. 4(7) GDPR. For enquiries about the processing of your personal data, or for further information about its use, please address NEC Laboratories Europe GmbH or our Data Protection Officer. Information about your data’s use includes its adaption or alteration, restriction, blocking, erasure or destruction as well as withdrawals for given declarations of consent. You may contact the Controller or Data Protection Officer by email, telephone, fax or by mail. In this context, your personal data given here will be used for processing your enquiry.

II. Processing of Personal Data

We process the data mentioned in this declaration of consent, in particular your name, title, professional background and research activities as well as your portrait photo and additional information you give us.

 

III. Legal Basis for the processing

The legal basis for processing your personal data in the context of joining the NLE Alumni Network and, publishing and maintaining a NLE Alumni professional profile, as described in this GDPR declaration of consent, is based on your consent (Art. 6 (1) (a) GDPR). The data collected in the declaration of consent will be processed in our legitimate interest and legal obligation for the purpose of proving your consent (Art. 6 (1) (c) and (f) GDPR).


IV. Retention

In the event of an objection or revocation of all or individual parts of the declaration of consent, all of the corresponding parts of your data will be deleted unless there is a statutory exception or legitimate interest to keep the data longer.

Your data will also be deleted if NLE no longer requires it for the above-mentioned purposes, e.g., if NLE terminates the service.

Please note that publication on the Internet means that personal data can be accessed and stored worldwide and that NLE has no influence on the data processing by any third parties who access and use your data. The data and the presentation can thus also be found, for example, via so-called "search engines". It cannot be ruled out that third parties may link the data with other personal data available on the Internet and thus create a personality profile, modify the data or use it for other purposes.

 

V. Your rights as a person affected by NLE’s data processing

  1. Right to withdraw my consent
    I shall have the right to withdraw my consent at any time Art. 7(3) sentence 1 GDPR. The withdrawal of consent shall not affect the lawfulness of processing based on my consent before my withdrawal
  2. Right of Access
    I may request information about my personal data from NLE. Where personal data is transferred to a third country or to an international organization, I shall have the right to request information of the appropriate safeguards pursuant to Article 46 GDPR relating to the transfer.
  3. Right to rectification/completion
    I shall have the right to request the rectification of inaccurate personal data without undue delay. The same applies to completion of incomplete personal data (Art.16 sentence 2 GDPR).
  4. Right to erasure
    I shall have the right to obtain, without undue delay, the erasure of personal data where one of the grounds according to Art. 17(1) GDPR applies.
  5. Right to restriction of processing of personal data
    I shall have the right to obtain the restriction of processing where one of the grounds according to Art. 18(1) GDPR applies. If processing has been restricted, such personal data shall – with the exception of storage – only be processed with my consent or for the establishment, exercise, defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State, Art. 18(2) GDPR. NLE shall inform me before the restriction of processing is lifted, Art. 18(3) GDPR.
  6. Right to data portability
    I shall have the right to receive my personal data, which I have provided, in a structured, commonly used and machine-readable format, Art. 20(1) GDPR. In exercising my right to data portability, I shall have the right to have the personal data transmitted directly from NLE to another controller, where technically feasible, provided this shall not adversely affect the rights and freedoms of others.
